Florida has recently become the sixth state to formally address the delivery of unbundled legal services via rule changes. A January 2004 ABA Journal eReport article by Jill Schachner Chanen, explores the shift towards unbundling in Florida and across the United States.
- The Florida Rules of Professional Conduct that relate to Unbundled services are:
- 4-1.2 (c) (Limitation of Objectives of Representation)
- 4-4.2 (Communication with Person Represented by Counsel)
- 4-4.3 (Dealing with Unrepresented Persons)
- Florida Family Law Rules of Procedure, Rule 12.040, governing Limited Appearance, Withdrawal or Limiting Appearance, Scope of Representation, Preparations of Pleadings or Other Documents, Notice of Limited Appearance, Service
- On March 13, 2002, The Florida Supreme Court asked the Florida Bar to provide for its consideration proposed rules regarding unbundled legal services. The report was filed on 8/28/02 and contains the proposed amendments to the Florida rules.
- Florida Bar News (August 15, 2002) article on the pending unbundled legal rules including recommendation on limited representation agreements.
- Notice of Filing in the Florida Bar News (September 1, 2002) from the Board of Governors of the Florida Bar on the proposed unbundled legal services rules. Includes the text of the proposed rules and invitation to comment.
