New York

  • In December 2002, the New York State Bar Association Commission Providing Access to Legal Services for Middle Income Consumers issued a report finding that "unbundled" legal services occurs and is permissible in a non-litigation context. In a litigation context, limited assistance in preparation of pleadings, etc., is allowed, but the attorney must disclose assistance (i.e., no ghostwriting, but disclosure does not constitute entry of appearance). However, no limited appearance should be allowed. Note that the report is not considered as the official position of the New York State Bar Association until adopted by the Executive Committee of the House of Delegates.
